Since the 1st of January 2021, the Act on the Stabilization and Restructuring Framework for Companies (Unternehmensstabilisierungs- und -restrukturierungsgesetz - StaRUG) has supplemented the "legal toolbox" for the restructuring of companies outside an insolvency.
At the end of April 2023, the StaRUG made its way into volume 2 of the 16th edition of "Uhlenbruck", edited by Prof. Dr. Heribert Hirte and Prof. Dr. Heinz Vallender, one of the most renowned commentaries on insolvency and restructuring law in Germany. The "Uhlenbruck" has always combined academic standards and practicality; authors are recruited from university professors and lecturers on the one hand and lawyers and judges on the other.
SJPP partners Dr. Christian Mikolajczak and Dr. Dietmar Penzlin contributed the commentary on the provisions on the so-called restructuring agent, the court-appointed supervisor in the context of a restructuring according to StaRUG (Sections 73 et seq. StaRUG) and his or her remuneration (Sections 80 et seq. StaRUG).
